  1. APPLICABLE WARRANTIES

All products offered through the website are completely original, unless otherwise stated in their description. All have a two-year warranty period, in accordance with the criteria and conditions described in Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other laws co mplementaries.

2. WARRANTIES AND RETURNS

The guarantee of the products offered will respond to the following articles based on Law 23/2003 of July 10 on Guarantees for the Sale of Consumer Goods:

2.1 Conformity of products with the contract

Unless proven otherwise, the products shall be deemed to be in conformity with the contract provided that they meet all the requirements set out below, unless in the circumstances of the case any of them is not applicable.

a) Fit the description made by SDT Brakes

b) Be eligible for any special use required by the customer when he has made it known to SDT Brakes at the time of conclusion of the contract, provided that the customer has admitted that the product is suitable for this use.

c) Be suitable for the uses to which products of the same type are ordinarily intended.

 

(d) Present the usual quality and performance of a product of the same type as the customer can reasonably expect, in view of the nature of the product and, where appropriate, descriptions of the specific characteristics of the products made by SDT Brakes.

(e) SDT Brakes describes the details, technical characteristics and photographs of the products provided by the manufacturer of the same, so that it is not bound by these public statements.

2.2 Responsibility of the PROVIDER

SDT Brakes will be liable to the USER for any non-conformity that exists at the time of delivery of the product. SDT Brakes grants the USER the right to repair the product, replace it, price reduction and contract termination.

3.0 APPLICABLE LAW AND JURISDICTION

These conditions shall be governed by or construed in accordance with Spanish law in matters which are not expressly established. The PROVIDER and the USER agree to submit any dispute that may arise from the provision of the products or services subject to these Conditions of the courts and tribunals of the domicile of the USER.

In the event that the USER is domiciled outside Spain, the PROVIDER and the USER expressly waive any other forum, submitting to the Courts and Tribunals closest to the town of Montcada i Reixac (Spain).

Online Dispute Resolution

Pursuant to Article 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for the resolution of online disputes between the USER and the PROVIDER, without the need for recourse to the courts of justice, through the intervention of a third party, called the Dispute Resolution Agency, acting as an intermediary between the two. This body is neutral and will dialogue with both parties to reach an agreement, and may ultimately suggest and/or impose a solution to the conflict.
